(Ocean City, MD) – Shorebilly Brewing announced on Facebook this week that it will change its name rather than fight a trademark infringement lawsuit. The dispute in this case is not with another brewery. More below…

As you may have heard, our little brewery has been battling a trademark lawsuit over the “Shorebilly” name. While it’s difficult to back down from a fight when you know you’re right, sometimes winning is not worth the price of victory. We want to put this behind us and focus our efforts on making great beer. To do this we’re going to change the name of our brewery, and we’d appreciate your help. We’ve come up with some fun names on our own, but we’ve always had luck asking you fellow shorebillies for ideas. You’re a fun & creative bunch and there’s got to be another word out there that describes our untamed and free spirited lifestyle here at the beach.
The person who comes up with our favorite name will get all the shirts, hats, skate decks, growlers, and anything else we print the new name on (except beer. Unfortunately we can’t legally give that away for free) and the distinction of having named a brand that will be around for the next hundred years. Good luck, have fun, and I can’t wait to invite you all to the giant party we will have when we announce the new name. Thank you so much.

East Coast SURF BUMS
Nice – as a former West Coast surf bum I kind of like Pete’s suggestion the best. I was thinking TOUGH KNOCKS brewing company? SECOND CHANCE? SHORED UP? SILVER LINING? Something that builds on the PR you’re getting from this event, unwelcome as it was. Too bad you can’t play with the term SHOREBULLY!
Whatever you choose, get a clearance opinion from a trademark attorney before investing in the name – not only do you get the benefit of knowing you won’t need to change the name, you also get a defense to the “intentional” part of any future threatened lawsuit, which greatly lessens the risk you’ll be in this situation again. Good luck!
